2024 Black Friday $25 Credit & Cyber Monday Giveaway Terms and Conditions
Overview
The 2024 Black Friday $25 Credit & Giveaway ("Promotion") consists of two separate offers designed to reward Pristine Auction users for their engagement during the holiday season:
Black Friday $25 Credit: Provides eligible Pristine Auction account holders with a one-time, single-use $25 credit, applicable exclusively to items won in auctions ending on November 29, 2024.
Giveaways:
Black Friday Giveaway: Entry is earned through bids placed on auctions ending on November 29, 2024. Winners are announced during Pristine Live! on December 2, 2024.
Cyber Monday Giveaway: Entry is earned through bids placed during the Pristine Live! event on December 2, 2024. Winners are announced live throughout the event.
These Terms and Conditions ("Terms") govern all aspects of the Promotion. For clarity, all references to "Pristine Auction," "we," "us," and "our" refer to JCK Enterprises L.L.C., doing business as Pristine Auction, an Arizona limited liability company. This Promotion is void where prohibited by law. Participants are responsible for ensuring their compliance with local laws.
Prize Information
Black Friday Giveaway Prizes: Multiple prizes will be awarded during Pristine Live! on December 2, 2024. Prize details, including specific items and their approximate retail values, will be announced live during the event. The cumulative retail value of all prizes will exceed $1,000 USD.
Cyber Monday Giveaway Prizes: Multiple prizes will be awarded throughout the Pristine Live! event on December 2, 2024. Prizes may include, but are not limited to, sports memorabilia, collectibles, and other merchandise available through Pristine Auction. The specific prize for each drawing will be announced immediately before the drawing occurs.
Odds of winning depend on the total number of eligible entries received.
1. Eligibility Requirements
General Eligibility
Participation is open to:
Legal residents of the United States who are 18 years of age or older at the time of entry.
International participants who are of legal age of majority in their jurisdiction of residence (but not less than 18 years).
Void where prohibited by law or where registration, bonding, or special approvals would be required, including New York, Florida, and Rhode Island.
Employees, officers, and directors of Pristine Auction, its affiliates, subsidiaries, advertising and promotion agencies, and immediate family members are not eligible to participate.
Valid government-issued photo identification may be required to claim prizes.
Account Requirements
All participants must maintain an active Pristine Auction account in good standing.
Accounts must comply with all standard Pristine Auction registration requirements and verification procedures as outlined in the Auction Policy.
Multiple accounts per individual are prohibited.
Pristine Auction reserves the right to verify the validity of accounts and entries at any time.
Use of automated entry devices, programs, or methods is prohibited.
Pristine Auction reserves the right to disqualify entries it suspects of being generated by bots or automated means.
Any participant found to be engaging in fraudulent activities, including creating multiple accounts or using automated systems to place bids, will be disqualified and may face account suspension.
International Participation
Participation is open to international bidders subject to these Terms.
International winners will be contacted individually to coordinate prize fulfillment.
Pristine Auction reserves the absolute right, in its sole discretion, to:
Disqualify any international winner.
Cancel or modify any international prize award if:
Shipping costs exceed $50.00 USD.
Customs restrictions prevent item import.
Legal barriers exist in winner's jurisdiction.
Force majeure events impact shipping.
Substitute a prize of equivalent value or provide reasonable credit compensation.
International winners must respond to inquiries within 3 days and provide requested documentation within 7 days.
International winners are responsible for all import duties, taxes, and fees.
2. $25 Credit Rules
Credit Application and Usage
The $25 credit will automatically apply to the final bid amount on items won in auctions ending on November 29, 2024, between 12:00:00 AM and 8:00:00 PM Mountain Standard Time (MST).
The credit is:
Non-transferable and cannot be redeemed or exchanged for cash.
Single-use only: Any unused balance will not roll over to other items.
Non-combinable with other promotional discounts or credits.
Valid only for the winning bid amount (excludes Buyer's Premium, taxes, and shipping costs).
Payment Processing
All payments must be made through approved payment methods as specified in the Auction Policy outlined on the Pristine Auction website.
Credit application is subject to successful payment processing.
3. Black Friday Giveaway Rules
Entry Methods
Primary Entry Method:
Each bid placed in any auction ending on November 29, 2024 (12:00:00 AM - 8:00:00 PM MST) counts as one (1) entry.
There is no limit to the number of entries per person through bidding.
Alternative Method of Entry (AMOE):

Full legal name
Registered email address
Pristine Auction account username.
Emails must be received and time-stamped by 8:00:00 PM MST on November 29, 2024.
Limit one (1) AMOE entry per person.
AMOE entries have equal chances of winning as bid-based entries.
Participants submitting an AMOE entry will receive a confirmation email verifying their entry has been successfully recorded.
Important: Pristine Auction is not responsible for lost, delayed, or misdirected emails due to technical or server issues. It is the participant's responsibility to ensure their entry is received before the deadline. Server timestamp on received emails shall be the sole determinant of entry time.
Winner Selection and Notification
Winners will be selected through a randomized electronic drawing system.
Drawing will occur during Pristine Live! on December 2, 2024.
Winners will be announced live and notified via email within 24 hours.
Non-Payment Clause: Participants who fail to pay for Black Friday auction items within the required payment window will be disqualified from the Giveaway.
4. Cyber Monday Giveaway Rules
Entry Methods
Primary Entry Method:
Each bid placed during Pristine Live! on December 2, 2024, counts as one (1) entry.
There is no limit to the number of entries per person through bidding.
Alternative Method of Entry (AMOE):

Full legal name
Registered email address
Pristine Auction account username.
Emails must be received and time-stamped by 12:00:00 PM MST on December 2, 2024.
Limit one (1) AMOE entry per person.
AMOE entries have equal chances of winning as bid-based entries.
Server timestamp on received emails shall be the sole determinant of entry time.
Participants submitting an AMOE entry will receive a confirmation email verifying their entry has been successfully recorded.
Winner Selection and Notification
Winners will be selected randomly during Pristine Live!
Winners must confirm their presence via live stream chat within two (2) minutes of announcement.
Alternative Confirmation Process: Participants unable to confirm live due to technical difficulties or other barriers must:
Notify Pristine Auction within two (2) hours of the live event's conclusion.
Will then have 12 hours to confirm via email.
Technical difficulties may include, but are not limited to:
Internet connectivity issues.
Browser compatibility problems.
Live chat functionality issues.
Time zone barriers.
Pristine Auction reserves the right to verify claimed technical difficulties.
Participants claiming technical difficulties may be required to provide time-stamped evidence, such as screenshots or error logs, demonstrating the issue.
Any participant found to be engaging in fraudulent activities, including creating multiple accounts or using automated systems to place bids, will be disqualified and may face account suspension.
5. Technical Requirements and Contingencies
System Requirements
Google Chrome is the recommended browser for optimal performance.
Participants are responsible for maintaining adequate internet connectivity for live stream participation.
Pristine Auction is not responsible for any technical failures, including but not limited to:
Internet connectivity issues.
Browser compatibility problems.
Device malfunctions.
Lost, delayed, or misdirected communications.
System Failures
In the event of a live stream interruption:
If the interruption is under 30 minutes, the event will resume from the point of disruption.
If the interruption exceeds 30 minutes, Pristine Auction reserves the right to reschedule the event within 24 hours.
Communication Reliability
Pristine Auction utilizes reasonable security measures to protect entry information.
Server timestamps are considered the official record for all entries and communications.
Participants are responsible for:
Ensuring email communications are directed properly.
Checking spam/junk folders.
Maintaining accurate contact information.
Having proper technical capabilities for participation.
6. Prize Fulfillment and Tax Requirements
Shipping Terms
Pristine Auction will arrange shipping through its chosen carrier(s).
If a prize is lost, damaged, or destroyed during shipping:
Pristine Auction may, at its sole discretion:
Attempt to replace the prize with a similar item.
Provide credit compensation of equivalent value.
Void the prize award entirely if fulfillment is deemed impractical.
Such decisions shall be final and binding.
Pristine Auction bears no responsibility for items lost or damaged during transit.
Tax Obligations
Winners are solely responsible for all taxes associated with prize acceptance.
For prizes valued at $600 or more:
U.S. winners must complete IRS Form W-9 before prize delivery.
International winners must provide appropriate tax documentation as required.
Pristine Auction will issue Form 1099-MISC where required by law.
Failure to provide required tax documentation within specified timeframes may result in prize forfeiture.
7. Privacy, Publicity, and Social Media
Data Collection
Information collected during the Promotion will be used in accordance with Pristine Auction's Privacy Policy (www.pristineauction.com/privacy-policy).
By participating, entrants consent to the collection and use of their information for Promotion administration.
Publicity Rights
Winners grant Pristine Auction permission to use their name, likeness, and entry information for promotional purposes without additional compensation, where legally permissible.
Social Media Platforms
This Promotion is not sponsored, endorsed, administered by, or associated with any other social media platform.
Information provided by participants is given to Pristine Auction, not to these platforms.
Participants release all social media platforms from any liability related to this Promotion.
8. Dispute Resolution and Legal Rights

Arbitration Agreement
BY PARTICIPATING IN THIS PROMOTION, YOU AGREE THAT:
All disputes will be resolved through binding arbitration in Phoenix, Arizona.
The arbitration will be conducted by the American Arbitration Association under its Consumer Arbitration Rules.
YOU ARE WAIVING YOUR RIGHT TO A JURY TRIAL.
YOU ARE WAIVING YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
You are limited to seeking relief on an individual basis.
The arbitrator's decision shall be final and binding.
Any claim must be filed within 90 days of its occurrence.
Choice of Law
These Terms are governed by Arizona law without regard to conflict of law principles.
The arbitration provisions shall be governed by the Federal Arbitration Act.
9. Force Majeure
Pristine Auction reserves the right to cancel, suspend, or modify the Promotion if any circumstance beyond its reasonable control compromises the Promotion's fairness or integrity, including but not limited to:
Natural disasters.
Technical failures.
Unauthorized intervention.
Public health emergencies.
Legal or regulatory changes.
Shipping or customs delays. In the event of Promotion cancellation due to force majeure, no refunds or compensation will be provided for entry-related costs or credits. Pristine Auction may, at its sole discretion, reschedule the event or provide reasonable alternative compensation.
